Terms of Service

By accessing or using LeadEngine (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms form a legally binding agreement between you and LeadEngine regarding your use of the Service.

LeadEngine is a lead-generation and marketing-automation platform for towing and repossession companies. The Service includes lead discovery, contact management, email and postcard campaigns, call campaigns, geo-scanning, and related tools.

We may modify, suspend, or discontinue the Service, or any part of it, at any time without notice. We are not liable to you for any such changes.

You must provide accurate, current, and complete information when creating an account, and keep that information updated.

You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You must be at least 18 years old and legally able to enter into contracts to create an account.

A paid subscription is required to access certain features. Subscription fees are billed on a recurring basis through Stripe, our payment processor.

Fees are billed in advance and are non-refundable except where required by law. You authorize us to charge your payment method for all applicable fees until you cancel.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access until then.

We may change our fees upon reasonable notice. Any price changes take effect at the start of your next billing cycle following notice.

You agree not to: use the Service for any unlawful purpose; upload or import data you do not have the right to use; infringe the intellectual property or privacy rights of others; attempt to access, disrupt, or reverse-engineer the Service; transmit malware or harmful code; or use automated systems in a way that overloads or impairs the Service.

You are solely responsible for the lead and contact data you enter or import, and for ensuring your use of that data complies with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and similar regulations.

You retain ownership of the lead data, contact information, campaign content, and other materials you submit to the Service ("Your Content").

You grant us a limited license to host, store, and process Your Content solely as needed to operate the Service for you.

You are responsible for ensuring you have the necessary rights and consents to use and store Your Content within the Service.

The Service, its features, design, and underlying software are owned by LeadEngine and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding.

Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that lead or campaign results will meet your expectations.

To the maximum extent permitted by law, LeadEngine and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold LeadEngine harmless from claims, damages, and expenses arising from Your Content or your violation of these Terms or applicable law.

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or pose a risk to the Service.

Upon termination, your right to use the Service ends. We may delete your data after a reasonable retention period.

We may update these Terms from time to time. We will notify you of material changes. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
